An article titled “To Mediate or Not to Meditate. Is That Still A Question to the Parties?” written by the President of the Institute of Mediators, Chan Shui Hung, has been circulated on the official WeChat channel of the Hetao International Commercial Mediation Center today. The article makes reference to a judgment of the UK Court of Appeal handed down last November, on whether pre-litigation mediation is contrary to the European Convention on Human Rights, as the basis to analyse the pre-litigation mechanisms in both the HKSAR and Macao SAR.
